The data protection act

Nowadays most companies & organisations store their employees/ customers personal information on computers such as:
 names and addresses
 financial details
 medical records
 criminal records
 employment history
Some people were worried that other people could see this information & maybe use it so The 1988 Data Protection Act (which came into force in 2000) was introduced to give rights to data subjects to protect their privacy.
Anyone who wishes to store personal information must register with the Data Protection Commissioner and follow the Principles of Data Protection.
The data user must ensure that the information is:
1. obtained with the consent (explicit or implicit) of the individual or data subject
2. only collected for one of a list of legitimate purposes - eg to fulfill a legal obligation, protect the individual, or carry out a public function
3. obtained fairly and lawfully
4. accurate and up-to-date
5. surrounded by proper security
6. only used for the registered purpose
The data subject has the right to:
1. see information stored about themselves
2. have it corrected if it is wrong
3. claim compensation in some cases
The Data Protection Act covers data stored on paper, as well as purely electronic data.
The Data Protection Commissioner has the right to inspect an organisation's computers to ensure they are complying with the Act.
